SALE of a property:
SELLERS have to ensure that an EPC has been commissioned before marketing of their property (unless an EPC is already available).
An EPC commissioned means that a Domestic Energy Assessor has been instructed to prepare an EPC, and that this EPC has either been paid for or a clear undertaking has been given to pay for it.
The person acting on behalf of the Seller (in the marketing of the property) should be satisfied that the above conditions have been met before commencing marketing.
The Seller (and person acting on behalf of the seller in the marketing of the property) should make reasonable efforts to secure and EPC within 28 days.
Fixed penalties are in force should the above not be complied with...
LETTING of a property:
An EPC must be given to a prospective Tenant when any written information about the property is provided, or when a viewing is conducted.
An EPC must always be handed to the actual Tenant at the commencement of the Tenancy.
